Employment Contracts in Suriname
Employment relationships in Suriname are governed by three contract types:
- Contract of employment (standard employee arrangement)
- Contract for services (used for independent contractors)
- Contract to perform certain services (typically project-based)
A valid employment contract must include:
- Direct supervision by the employer
- Personal performance of work by the employee
- Employer-paid salary
There is no legal requirement for written contracts, but they are highly recommended—particularly for clauses involving non-compete terms, penalties, or notice. Contracts may be open-ended or fixed-term.
Statutory Employment Regulations in Suriname
Working Hours
- Standard maximum: 8.5 hours/day, 48 hours/week
- Security personnel: up to 12 hours/day, 72 hours/week
- Security-related staff (non-exclusive): up to 10 hours/day, 60 hours/week
- Sunday and national holiday work is restricted unless authorised by the Labour Inspectorate
- Overtime requires a formal permit
Probation Period
- Maximum duration: 2 months
- During probation, either party may terminate immediately without cause or notice
- Extensions or repeated probation periods are not legally valid
Paid Annual Leave
- Minimum: 12 vacation days/year after a full uninterrupted calendar year
- Additional 2 days/year accrued for each full year of continuous service, capped at 18 days
- Use of vacation leave is mandatory and cannot be converted to notice period compensation
- Leave must be used by the end of the following year
- Employers must pay a vacation allowance (at least 50% of daily wage per vacation day) in addition to normal salary
Sick Leave and Protections
Employees may not be dismissed while:
- On sick leave
- On military or compulsory civil service
- Temporarily unavailable due to authorised public obligations
Exceptions apply for short-term or minor employment arrangements.
Termination of Employment in Suriname
Termination Rules
- Must occur on a date agreed in contract or based on customary payment cycles
- Employees with illness, compulsory service, or protected absences cannot be dismissed during that period unless specific exceptions apply
- Termination notice must align with wage payment intervals, with a minimum of 1 week
Notice Periods
For employers:
- Employment < 10 years: same number of weeks as years of service
- 10–15 years: 4 months
- 15 years: 6 months
For employees:
- Employment < 10 years: same number of weeks as half of service years
- 10–15 years: 2 months
- 15 years: 3 months.
Minimum Wage in Suriname
As of April 1, 2024, the national minimum wage in Suriname is SRD 49.12 per hour.
